These Terms of Service constitute a contract between Datascend and you, and are meant to help you understand your rights and our rights while using our products.
1. About Us & Our Services
We might use “Eigen”, “Company”, ”we”, “our”, or “us” in this document which would be referring to Eigen and Datascend in general.
The “Service” — Eigen is our next-generation productivity platform that integrates tasks, notes, files, and meetings into one seamless AI-powered workspace. Developed by us ( Datascend — a team of techies from Kolkata, India) our mission is to redefine how people interact with AI in their daily workflows, and re-define the very aspect of user experience when using AI-Powered Productivity tools.
When you use our Services, now or in the future, you are agreeing to the latest Terms of Service. That’s true for any of our existing and future products and all features that we add to our Services over time. There may be times where we do not exercise or enforce any right or provision of the Terms of Service; in doing so, we are not waiving that right or provision. These terms do contain a limitation of our liability.
If you do not agree with the terms, do not use this service. If you violate any of the terms, we may terminate your account. We understand this is an exacting statement, and we take it seriously to enforce our policies only in extreme cases.
2. Content, Accounts, and Spaces
We define as "Content" as any text, image, audio, video, or any material posted, generated, or made available through Eigen. We define "User Content" any Content provided by an account holder.
You agree not to remove, alter or obscure any copyright or trademark accompanying the Service or Content. Saga gives you right to download, copy, display and print the Content. We do not claim any ownership rights in any User Content, nor we restrict any rights that you may have to use and exploit your User Content. You retain all your rights (including copyright) in any User Content you submit, post or display using the Service. You are solely responsible for all your User Content. We take no responsibility and assume no liability for any User Content you or any other person posts on or through the Service.
To access our services, you would need to register tusing personally identifiable data. You are responsible for maintaining the confidentiality of your account information. Eigen never has access to your passwords and will never sell this data to others or for advertising. Please do not share them with anyone claiming to be a representative of Eigen. Users are responsible for all content stored, shared, or created in their Eigen workspace. You must notify us immediately in case you become aware of a breach or unauthorized use.
Your Content can be organized in Spaces as a part of our service. You can have multiple spaces.
3. Pricing Plans
Eigen offers both free and paid plans. We will always have a free plan for users, ensuring everyone can access the core functionalities of our services.
Paid plans may come with additional capabilities and integrations. From time to time, we might offer a free trial for our paid plans. We may do so at our discretion, and we may, at any time, and without giving notice, modify the terms and conditions that apply to this Free Trial, or cancel it.
We might also have promotional trial offers where we provide all our paid subscription tiers for free of cost for early users, but we can at any time change those policies and you can be prompted to be charged if you wish to keep using those services.
Refund policies will be clearly stated before any purchase, and refunds will be processed according to our policy.
4. Billing, Fees and Changes, Refunds
Subscription fees are billed in accordance with the selected plan. When on a paid plan, you will be billed in advance on a recurring and periodic basis referred to as the "Billing Cycle" which can be on a monthly or yearly basis.
A valid payment method, is required to process the payment for your plan. You shall provide Datascend with accurate and complete billing information. By submitting such payment information, you automatically authorize us to charge all Subscription fees incurred through your account to any such payment instruments.
If the automatic billing fails to occur for any reason, we may attempt to charge the one or more times. If the payment continues to fail beyond one (1) week since the end of the previous Billing Cycle, the Subscription plan would be terminated.
You may cancel your Subscription either through your online account management page of the Service or by contacting our customer support team.
We reserve the right to modify pricing, but changes will be communicated well in advance. Continued use of paid services after price changes constitutes acceptance of the new fees.
Processed payments are non-refundable and there are no credits for unused Subscription periods. You may continue to use the Subscription until the end of the current Billing Cycle. Certain refund requests for Subscriptions may be considered on a case-by-case basis and granted in sole discretion of Saga.
5. Communication
By using Eigen, you agree to receive service-related notifications via email or in-app messages. You may opt out of marketing emails, but important notifications regarding your account and security cannot be disabled.
6. Intellectual Property and Restricted Use
The Service and the content of the Eigen and Datascend website are protected by intellectual property rights including copyright and trade marks. We reserve all our rights in such intellectual property. Do not use our trademark or copyright unless you have written consent from Eigen or Datascend explicitly.
You may not:
post any User Content through the service which may reasonably be regarded as offensive, unlawful, threatening, abusive, harassing, defamatory, obscene, sexually explicit, or racially, ethnically or otherwise objectionable or add links to other websites which may contain any such material;
post any Content or other material through the Service that contains a virus or other malicious code;
try to duplicate, decompile or reverse engineer the Service which can damage or disrupt the Service or any such attempt to gain unauthorized access to other’s user account;
use the Service for illegal, harassing, unethical, or disruptive purposes;
7. Links to Third-Party Websites or Services
The Service and any of the Content you access using our Services may provide links to other websites. Selecting any of these links will direct you to a website that is not related to us in any ways. Datascend takes no responsibility for the content contained on any such website, and the link to these other websites does not imply an endorsement or recommendation of the website, its products or services.
8. Termination
We may give you a notice to terminate your use of the Service with immediate effect if:
you breach any of these Terms, or
we have our own verifiable reasons to believe that you are using the Service in an unauthorised, unlawful, illegal or fraudulent manner, or
you fail to pay any Charges due to us.
On termination for any reason (unless you have the right to terminate), no refund of any Charges that have already become due and have been paid will be made.
If you wish to terminate your use of the Service, you may delete your account at any time from within our account management page or by contacting our support team. Once we receive your request to delete your account, all the Content for which you are the Author will immediately become inaccessible. After 30 days, the Content will be deleted from our servers and can no longer be recovered.
9. Limitations of Liability
Eigen is provided "as is" without warranties of any kind and we provide the Services using reasonable care and skill.
We will not under any circumstances be liable for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use our services.
Users are responsible for adhering to their institution’s academic policies; Eigen is not liable for any academic dishonesty claims.
In addition to this terms, you might want to take a look at our Privacy Policy. We may update these Terms of Service in the future. Whenever we make a significant change to our policies, we will also announce them with a notice on our Services and via email notification. Please read them carefully before using our service.
